1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website rentcarzurich.com ("Platform") and any vehicle rental services arranged through it. By accessing the Platform, completing a reservation, or picking up a rental vehicle, you agree to be bound by these Terms in full. If you do not accept these Terms, please do not use the Platform or proceed with a booking.

These Terms apply to all users, including visitors browsing the Platform, registered account holders, and confirmed renters. We reserve the right to update these Terms at any time. The version published on the Platform at the time of your booking governs your reservation.

2. Eligibility Requirements

To rent a vehicle through this Platform, you must meet the following eligibility criteria:

• You must be at least 21 years of age at the time of pickup. Drivers between 21 and 24 may be subject to a young driver surcharge, which can be waived with the applicable protection plan.
• Renters of premium and luxury category vehicles must be at least 25 years of age.
• You must hold a valid, full driving licence that has been held for a minimum of 1 year at the time of rental. Provisional or learner licences are not accepted.
• EU, UK, US, Australian, and Swiss national licences are accepted without additional documentation. Drivers from other jurisdictions must present a valid International Driving Permit (IDP) alongside their national licence at pickup.
• All drivers listed on the rental agreement must be present at pickup and must meet the same eligibility requirements as the primary renter.

Zurich cantonal regulations and Swiss federal road traffic law apply to all vehicle use within Switzerland. You are responsible for ensuring your licence category covers the vehicle class you have reserved.

3. Bookings and Cancellations

All reservations are made through the Platform's booking system. A booking confirmation is issued by email upon successful reservation. Your reservation is not guaranteed until you receive this confirmation.

Free cancellation is available on most vehicle categories when cancelled at least 24 hours before the scheduled pickup time. Cancellations made within 24 hours of pickup may incur a fee equivalent to one day's rental rate.

No-shows - where a renter fails to collect the vehicle at the agreed time without prior cancellation - will be charged a no-show fee equal to one full day's rental. The vehicle will be released for other renters after 60 minutes from the scheduled pickup time unless prior arrangement has been made.

Booking amendments (date changes, vehicle upgrades, or location changes) are subject to availability. Amendments made within 12 hours of pickup may not be possible. Contact our support team at [email protected] to request any changes to an existing reservation.

4. Pricing and Payment

All prices displayed on the Platform are shown in Swiss Francs (CHF) unless otherwise stated. The displayed rate includes the base rental, standard CDW insurance, theft protection, and unlimited mileage where specified.

The following optional extras may be added to your reservation at additional cost:

• GPS Navigation: Available on request, charged per rental period.
• Child Seat / Booster Seat / Infant Seat: Compliant with Swiss road safety regulations. Charged per seat per rental period.
• Additional Driver: Each additional named driver is charged a daily fee. All additional drivers must be present and eligible at pickup.
• Full Coverage Upgrade: Reduces or eliminates the excess liability on collision and theft claims.
• Roadside Assistance Package: Provides 24/7 breakdown support throughout Switzerland and participating European countries.

We accept payment by debit card and major credit cards. No deposit or credit card hold is required at the time of online booking. Payment terms at pickup are confirmed in your booking documentation. Fuel policy is full-to-full: the vehicle must be returned with the same fuel level as at collection, or a refuelling charge will apply.

5. Vehicle Use Rules

All rental vehicles must be used in a lawful manner and in compliance with Swiss traffic regulations, including all cantonal rules applicable in Zurich and surrounding regions. The following activities are strictly prohibited:

• Off-road driving or use on unsurfaced tracks not designated for standard vehicles.
• Use of the vehicle in any form of racing, speed testing, or competitive driving event.
• Subletting, reselling, or allowing any person not listed on the rental agreement to drive the vehicle.
• Driving under the influence of alcohol, drugs, or any substance that impairs judgement. Switzerland enforces a strict legal blood alcohol limit of 0.5 mg/ml for standard drivers and 0.1 mg/ml for new and professional drivers.
• Transporting the vehicle on a ferry, train car, or cross-border route not permitted under the rental agreement without prior written consent.
• Using the vehicle for commercial transport of passengers or goods without prior written approval.
• Towing or pushing another vehicle unless expressly permitted in your rental documentation.

Violation of any vehicle use rule may result in immediate termination of the rental agreement, full liability for damage or loss, and forfeiture of any insurance protection.

6. Insurance and Liability

All rental vehicles include basic Collision Damage Waiver (CDW) and Theft Protection as standard. These coverages reduce your financial liability in the event of an accident or theft, subject to an excess (deductible) amount stated in your rental agreement.

The standard excess for economy and compact vehicles is CHF 800. For premium, SUV, and 7-seater categories, the standard excess is CHF 1,200. These amounts represent the maximum you would be charged for a single covered incident.

Optional full coverage upgrades are available that reduce the excess to zero and extend protection to glass, tyres, and undercarriage damage. Personal Accident Insurance covering the driver and named passengers is also available as an add-on.

Insurance coverage does not apply in cases of: reckless driving, wilful damage, DUI, breach of vehicle use rules, use of the vehicle by an unlisted driver, or incidents occurring outside the permitted geographic territory. In these circumstances, the renter bears full financial responsibility for all damage, recovery, and third-party costs.

7. Limitation of Liability

rentcarzurich.com operates as a booking platform connecting customers with vehicle rental suppliers in and around Zurich. While we take care to work with reputable suppliers, we are not the direct provider of the rental vehicle and cannot guarantee the actions or omissions of any third-party supplier.

To the maximum extent permitted by applicable Swiss law, our liability to you in connection with any booking or rental is limited to the total amount paid by you through the Platform for the affected reservation. We are not liable for indirect, consequential, or special damages, including but not limited to loss of enjoyment, missed flights, or business losses arising from vehicle unavailability or delay.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Swiss law.

8. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland, with particular reference to the Swiss Code of Obligations (OR) and applicable cantonal regulations of the Canton of Zurich. Any dispute arising from or in connection with these Terms or a rental arranged through the Platform shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
